Declaring the system a failure is easy, but the real question is: Do we fulfill our own responsibilities? Every day, disputes arise between buyers and sellers, service providers and clients, landlords and tenants. When these disputes reach a lawyer, the same issue appears repeatedly: the affected person has no evidence to prove their claim. The right exists, but the proof does not.

When asked whether there was a written agreement, the answer is usually, “No, it was only a verbal agreement.” How was the payment made? “I paid in cash.” Was there a receipt? A bank transaction? A cheque? Any record? Nothing. And even if an agreement exists, it is often a simple copy-paste document used for transactions worth millions of rupees. It clearly defines neither rights nor responsibilities, neither terms nor conditions, nor the method for resolving disputes. As a result, when fraud occurs, that piece of paper becomes worthless.

This negligence is not limited to one sector. Event planners, caterers, decorators, photographers, freelancers, online sellers, and property buyers conduct transactions worth millions every day without any written evidence. They rely on verbal promises, fail to obtain receipts, and ignore legal precautions. Then, when they suffer losses, they blame the system, even though the real weakness lies in their own negligence.

Consider the example of an event planner. They organized an entire event, received an advance payment, and provided all the agreed services. After the event, the client raised objections regarding services that were neither part of the agreement nor included in the charges. Using those objections as an excuse, the client withheld the remaining payment. When asked whether there was a written agreement, receipt, or even a WhatsApp confirmation, the answer was, “No.” She knew she had been treated unfairly, but without evidence, her case was weak.

Another individual paid a substantial amount to purchase a property. Later, it turned out that the land did not even exist. Surprisingly, they had not even visited the site before making the payment. There was no agreement, no verification, and no legal precaution. The loss was the result of their own negligence. These stories are not isolated incidents—they are collective realities. Thousands of people in Pakistan conduct business in this manner every day and then blame the system after suffering losses.

Perhaps the saddest aspect is that our own religious teachings provide us with clear guidance on this matter. The longest verse in the Holy Qur’an, Surah Al-Baqarah, Verse 282, clearly instructs:

“O you who have believed, when you contract a debt for a specified term, write it down.”

More than fourteen centuries ago, we were taught the principles of written agreements, witnesses, and honesty. What we now call legal documentation and safety protocols had already been established for us. Yet, instead of following these principles, we have only learned to criticize.

Courts are not weak, and the law is not powerless. Weakness arises when we have no evidence. Judges decide cases based on evidence, not emotions. Therefore, documents are not merely pieces of paper—they are shields that protect your rights. Written agreements clearly define rights and responsibilities. Receipts and invoices provide undeniable proof of payment. Bank transactions leave records that cannot be denied. Verification ensures that the property or service actually exists. All these measures safeguard your legal rights.

We often wish for the system to improve, for courts to deliver quicker judgments, and for laws to become stricter. But if we do not change our own habits, no system can protect us. If you seek justice, you must first fulfill your own responsibility. Put every significant financial transaction in writing. Always keep receipts or bank transaction records. Verify everything before making payment. Preserve your records carefully. The cost of precaution is always less than the cost of loss. A contract worth a few thousand rupees can save millions. A few minutes of verification can prevent a lifetime of regret.

Legal language may seem complicated to the average person, but you do not need to be a lawyer to protect yourself. Discipline and responsibility are enough. Think of documentation as insurance: you hope you never need it, but when the time comes, it is what protects you. Freelancers should obtain written project scopes. Caterers should issue invoices and maintain payment records. Property buyers should review title documents and verify ownership. Even small businesses should preserve receipts and agreements. These are not luxuries—they are necessities.

It is easy to criticize lawyers; admitting our own mistakes is much harder. Fraud succeeds only because the victim failed to take precautions. If we truly want a better society, we must change our habits. We must embrace documentation, verification, and caution. We must remember that the Qur’an itself instructs us to document financial transactions. Justice is not established only in courtrooms—it also begins with our everyday responsibilities.

The law is not weak; our negligence makes us weak. Courts decide cases based on evidence, not emotions. If you want your rights to remain protected, safeguard your documents. A written agreement, a receipt, and a bank record are your shield. Ultimately, precaution is not merely legal advice—it is the hallmark of a responsible citizen. And responsibility, more than criticism, is what strengthens society.

Islamabad (Digital Post) The Cost of Negligence: Why Documentation Protects Your Rights By: Uzair Razzaq Advocate | Columnist, Expert in Government Reforms and Transparency Email: uzair.razzaq@gmail.com In our society, criticizing lawyers, blaming the courts, and condemning the government has become a common practice.
